Terms of Service

These terms are an agreement between you (the operator who creates a WaveOps account on behalf of your company) and Pool Builder's Services, LLC, the operator of WaveOps ("we", "us"). By creating an account or using the service, you agree to them.

The service

WaveOps is software-as-a-service for pool service companies. You use it through a web browser (including the installable progressive web app on iOS, Android, or desktop) to manage your customers, schedule and dispatch stops, log pool chemistry, send invoices and estimates, and accept card payments.

We work hard to keep the service available and accurate, but we don't guarantee zero downtime or that every feature works perfectly in every configuration. We will give reasonable notice for scheduled maintenance.

Your account

  • You must be at least 18 and have authority to bind your company to this agreement.
  • You're responsible for keeping your password secure and for everything done under your account.
  • The information you give us about your company must be accurate and current.
  • If you give a team member access (a tech, an office assistant), you're responsible for their use of the service.

Subscription and payment

  • WaveOps is a paid subscription. Pricing is published on our website and inside the app at the time you sign up.
  • Subscriptions are billed in advance and renew automatically until you cancel.
  • Annual plans are billed twelve months in advance. If you subscribe at a promotional annual rate, that rate applies to your first year only — your subscription renews at the then-current annual rate published here at the time of renewal, and we'll give you notice before it does. The current promotional annual rate is available through October 31, 2026.
  • You can cancel from your account settings at any time. Cancellation takes effect at the end of the current billing period.
  • Fees are non-refundable except where required by law. If we make a material change that materially reduces the service you signed up for, we'll offer a prorated refund.
  • If your payment fails, we'll notify you and give you a reasonable window to update it before suspending access.
  • Transaction fees from third-party providers (Stripe card processing) are passed through at cost; we don't mark them up.

Annual prices shown are the launch promotional rate — 12 months of service for the price of 10 — and are available through October 31, 2026. That rate applies to your first year; renewals bill at the then-current annual rate.

Acceptable use

You agree not to:

  • Use WaveOps to send spam, harass anyone, or break the law.
  • Attempt to break, probe, or reverse-engineer the service, the security of the service, or the data of other operators.
  • Resell access to WaveOps to other businesses without our written permission.
  • Upload content you don't have the right to use (including photos of property you weren't authorized to photograph).
  • Use the service to violate any law, contractual obligation, or third party's rights.

We may suspend or terminate your account if you do any of these. We'll explain why, in writing, when we do.

Your data

You own the data you put into WaveOps — your customer list, your schedules, your photos, your invoices, all of it. We have a limited license to host, process, and display that data only as needed to operate the service for you and to make it available to you and the team members you authorize.

You can export your data at any time from Settings → Export. After you cancel, we retain your data for 30 days and then delete it permanently. See our Privacy Policy for more.

Third-party services

WaveOps uses third-party services (Supabase for hosting, Stripe for card payments, Twilio for our phone line, Resend for email, Anthropic for AI features). When you use the corresponding features, you also implicitly use those services. If any of them is temporarily unavailable, the related WaveOps feature may be too. We're not responsible for outages on third-party services we depend on, though we'll do our best to keep you informed.

Disclaimers

The service is provided "as is" and "as available." To the maximum extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that AI-generated content (such as automatic note translations or chemistry-dosing suggestions) is correct in every case — it's a starting point for your professional judgment, not a substitute for it.

Limitation of liability

To the maximum extent allowed by law, our total liability to you for any claim arising out of this agreement or your use of the service is limited to the total amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, or lost data — even if we've been advised of the possibility of such damages.

Indemnification

You agree to defend and indemnify us against claims arising from (a) your violation of these terms, (b) your violation of any third-party right, or (c) data you uploaded to the service.

Termination

  • You can stop using the service or cancel your subscription at any time.
  • We may suspend or terminate your access if you breach these terms, fail to pay, or use the service in a way that's harmful to other users or to us.
  • On termination, your right to use the service ends. The sections of these terms that by their nature should survive (Your data, Disclaimers, Limitation of liability, Indemnification, Governing law) survive.

Changes to these terms

We may update these terms from time to time. If a change is material, we'll email you and give you at least 14 days' notice before it takes effect. Continued use after the change means you accept the updated terms; if you don't, you can cancel.

Governing law and disputes

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. Any dispute arising out of these terms or your use of the service will be brought in the state or federal courts located in Texas, and you and we both consent to the jurisdiction of those courts.
